You’re Free To Travel While Transgender, Protected From Queer Partner Violence

Hey look, legal things happened that are good for us! The acting assistant attorney general of the Justice Department’s Office of Legal Counsel has concluded that the same rules enforced by the Violence Against Women Act can and should be applied to stalking and partner violence situations regardless of the genders of the partners involved. “Brian Moulton, the chief legislative counsel of the Human Rights Campaign, a gay and lesbian advocacy group, said his group asked the Obama transition team after the 2008 election to have the office “clarify” for prosecutors that the Violence Against Women Act covers violence that might arise in same-sex relationships.

“It’s a step towards equality and recognizing that our relationships exist and are subject to the same sorts of issues that face other committed couples,” Mr. Moulton said. “Unfortunately, sometimes that is domestic violence and other issues that need to be dealt with through the criminal justice system.”

The act uses gender-neutral language, and terms like “dating partner” and “intimate partner.” This doesn’t necessarily mean that the government will suddenly take up the charge against GLBT partner violence; let’s be real, you’re pretty much SOL as far as government protections from violent partners go no matter how traditional your family is. And while prosecutors are advised to adhere to the Violence Against Women Act regardless of the genders of the people involved, it’s unclear what measures are in place to make sure prosecutors follow these guidelines, or if there are any consequences if they don’t.

But also! Also! The State Department has announced that passports are now available that specifically address transgender citizens, even those who don’t plan to undergo SRS. The website makes it sound so easy you could do it in your sleep: “if you bring a note from your doctor that you’ve undergone “appropriate clinical treatment for gender transition,” you’ll be able to get a passport to match. If you’re still in the middle of the process of switching over, don’t worry, you can get a “limited-validity passport” until everything is settled. And for those who don’t want to go through surgery? You’re clear to travel now, too. “Sexual reassignment surgery is no longer a prerequisite for passport issuance,” the State Department said.” The jury is still out on what this will mean for those who have a nonconforming gender presentation/identity but haven’t undergone “clinical treatment,” because what does clinical treatment mean in this context, I’m honestly not sure. Local queers are angry about a letter to the editor run in the newsletter of the Boston Archdiocese in which a heterosexual man writes that Catholic schools shouldn’t allow the children of gay parents to attend, because, among other things, they are more likely to bring porn to school. The paper has apologized to anyone offended by the article. (@necn)

  1. RE: The adjusted recognition with the Violence Against Women Act. It’s a good gesture no matter how it turns out. I lived in South Carolina in 2004 (it was a weird year, okay, and it allowed me access to fangirl John Edwards from a few miles away – you know, pre-“I did not have an affair! Okay maybe I did but I didn’t get her pregnant! Okay, I got her pregnant, JFC” shenanignans) and after an ex smacked me during a fight I was denied legal protection because, as the judge said so eloquently, “You were fussing and fighting beforehand. That’s what women do.” Oh. I see. That’s what we DO.

    In other news, when I see “Log Cabin Republicans” and “tea bag,” Earl Grey is not the first thing that comes to mind. Then I read the description and clicked on the link and I’m not entirely sure the warm caress of orange pekoe was on the LCR’s mind, eiter.

    I agree, the overall tragedy of the situation could do without the whole emphasizing that they’re “lesbian lovers” when (a) it’s not relevant to said situation (b) people could figure it out based on them being called a couple + their names, the mentions of female prisons and use of female pronouns, etc. (c) the word lovers just takes it to a whole other sleazy level (d) ‘(b)’ shouldn’t be unnecessary because ‘(a)’.

    I’m pretty good at missing the point; maybe it was that the word ‘lovers’ really disturbs people, fictional and real alike? Because I think E.Lemon said it best when she said: “That word bums me out unless it’s between the words ‘meat’ and ‘pizza.’” And I don’t even like meat as a pizza topping, but the word ‘lovers’ does bum me out.

    Also, the “everything under the sun” bit confused me. Was one insulting the other with every expletive imaginable or was Cowan really yelling “You’re everything under the sun, Susan Taylor!”?
